Partner David D. Wilson Wins Large Verdict for Dillard's

David D. Wilson, a partner in the firm's Little Rock office, represented Dillard's, Inc. along with Texas counsel Susman Godfrey, LLP, in a jury trial involving a dispute over a software licensing agreement between JDA Software Group Inc. and Dillard's. Dillard's, based in Little Rock, operates more than 320 department stores and clearance centers in 29 states. The company paid JDA subsidiary i2 Technologies $8 million to license software that helps retailers manage inventory. Dillard's alleged that i2 Technologies software had failed to perform as represented and that i2 had breached the licensing agreement, committed fraud and caused Dillard's damages. i2 also made counterclaims of misappropriation of trade secrets and breach of contract against Dillard's. A Texas jury in state district court of Dallas County ruled in favor of Dillard's and awarded Dillard's $88 million in actual damages and $150 million in punitive damages.
