On September 9, President Biden announced sweeping new policies that, if implemented, will require mandatory vaccination policies for federal employees and contractors and qualifying employers and healthcare facilities. The mandates will cover approximately 100 million Americans, which make up two-thirds of the workforce. We expect further guidance for employers and healthcare facilities to be issued in the coming weeks.

An indigent birth parent who seeks to protect her parental rights is not entitled to appointed counsel in only one instance – if she objects in a private adoption. Act 599 of 2021 gives her the right to counsel if she consents to the adoption. And Ark. Code Ann. § 9–27–316(h) provides a right to appointed counsel in dependency and neglect proceedings brought by the state. However, the indigent birth parent who desires to contest a private adoption and protect her rights has no right to assistance of counsel.

The Employee Retention Credit (ERC) was created by the CARES Act to encourage employers to keep employees on their payroll during the pandemic. Through subsequent legislation, Congress amended and extended the credit and the availability of certain advance payments of the credits through the end of 2021. Notably, following the subsequent amendments, businesses that received a Paycheck Protection Program (PPP) loan are now eligible to also claim the ERC provided certain qualifications are met.
